I agree with you tmboy, that the TTAB got Fiore wrong.  And so does Mr. Welch.  But I disagree that Italian is not a language spoken by a sizable portion of the 'Merican public.  Ever been to Providence, or Little Italy in Bal'mer, or Newark, or North End of Boston, Brooklyn or Bensonhurst in NYC, or, hell, anywhere in NYC?  &lt;br /&gt;

According to the Sons of Italy News Bureau from 1998 to 2002, the enrollment in Italian language courses grew by 30%, faster than the enrollment rates for Spanish, French, and German. Italian is the fourth most commonly taught foreign language in U.S. colleges and universities behind Spanish, French, and German. According to the U. S. 2000 Census, Italian (besides English and Spanish) is the fifth (seventh overall) most spoken language in the United States (tied with Vietnamese) with over 1 million speakers.2&lt;br /&gt;

The Board got this one wrong.  The test for a 2(e)(4) refusal is whether the mark is PRIMARILY merely a surname, not whether it is ONLY a surname.  Furthermore, if the Board wishes to impart a translation test into the 2(e)(4) analysis, they should choose a language spoken by a sizable portion of the American public.  Italian is NOT a language spoken by a sizable portion of the American public.    </content:encoded>
